Your third stimulus payment can't be seized to pay child support. Under the CARES Act from March 2020, your first stimulus check could be seized by state and federal agencies to cover past-due child support… And like the second check, your third check cannot be taken to pay overdue child support.

Unfortunately, not everyone who gets the $1,400 stimulus check will get to spend it in full… For instance, your third stimulus check will NOT be garnished to cover debts owed to state or federal governments, including unpaid child support, taxes, and more. Luckily, those debts DO NOT include late child support payments, meaning your third check cannot be garnished to pay child support. While many people know that past due child support will not take their third stimulus check, what they may not know is a process called “budget reconciliation” currently allows garnishment for other debts.

If you are not supporting a spouse or child, up to 60% of your earnings can be taken, and an additional 5% can be taken if you’re more than 12 weeks behind in payments.
