If it is illegal in your state — I do believe that they can take your baby away (but only with other issues of neglect or a lack of safety). That does not mean that they WILL take your baby away. Family court’s goal is to always keep families together if at all possible. Will they take my baby if I test positive at birth? Likely, no. However, it will trigger a CPS visit to you, and possibly one to your home.

Even in the case of fully state legal marijuana, parents are expected to keep the plant and the smoke completely out of the vicinity of the child and away from the child’s access. This means that parents are not only responsible for keeping marijuana in a different area than the child, but they’re also responsible for locking it up or otherwise making sure the child cannot ever reach it, as well.

Child Protective Services cannot simply take your children away from your home. Except in exigent circumstances, a court order is required before CPS can legally remove a child from your home without your consent. Exigent means that an emergency is actively taking place and action must be taken immediately.
